Welcome to BrooksKits.com (the “Site”), operated by Brooks Advertising, Inc., an S-Corp registered in Arkansas (“Company,” “we,” “us,” or “our”). By accessing this Site, purchasing digital products, or subscribing to monthly marketing services, you agree to these Terms & Conditions (“Terms”). If you do not agree to these Terms, please do not use the Site.

Use Of Site

You may use the Site for lawful purposes only. You agree not to:
Interfere with or disrupt Site functionality
Access the Site in a way that could harm our servers, security, or users
Copy, redistribute, or commercially exploit any content without permission
We reserve the right to suspend or terminate access to the Site, digital products, or subscriptions without refund if these Terms are violated.

Digital Products

2.1 License
‍All digital downloads—including templates, PDFs, strategy documents, and tools—are licensed for single-company internal use only.
You may not:
Resell or redistribute
Share publicly or upload elsewhere
Claim authorship
Modify and resell derivatives
Violations may result in termination of access and legal action.
‍2.2 Delivery Digital downloads are delivered electronically via our designated delivery platform after purchase. If you experience issues accessing your files, contact us at info@brookskits.com
2.3 Refund Policy All digital product sales are final due to the instant-access nature of downloads.

Monthly Marketing Kits Subscription

3.1 Inclusions Each subscription tier (Spark, Authority, Lead Engine) includes the clearly defined monthly deliverables listed on the Site. All work is done asynchronously and delivered via the client dashboard.
3.2 Delivery Schedule Monthly Marketing Kits are delivered on a scheduled cadence based on signup date and cutoff rules published on the Site. Delivery of kit occurs on the 1st of the month depending on enrollment timing. Delivery occurs regardless of weekends or holidays.
3.3 Revisions Revisions must be submitted through the designated request form within the stated window. Additional revisions may incur a fee.
3.4 Billing & Cancellation
Brooks Kits are billed monthly.Your billing date is the day you originally subscribed.

Cancellation
You can cancel anytime from the billing link in your dashboard.
When you cancel, your subscription stays active until the end of your current billing period.
Billing does not stop immediately.

A real example:
If your billing date is the 23rd and you cancel on June 23:
Your subscription remains active through July 23
The July 1 kit is already in production and will be delivered
Your subscription ends on July 23
You will not receive an August kit
No additional charges occur after July 23

Once a kit enters production, it cannot be refunded. You keep and own all delivered content.To see your billing date or cancellation date, use the billing link in your dashboard.

If your billing date falls after the 1st, your next kit will already be in production when you cancel.

Custom Services

Brooks Advertising, Inc. may offer selective custom marketing services. Any such services are governed by separate written agreements and are not included in monthly Kits unless explicitly stated.

Intellectual Property

All Site content—including templates, strategy frameworks, messaging systems, marketing kits, and digital assets—is owned by Brooks Advertising, Inc.You may not reproduce, distribute, translate, or create derivative works without explicit written permission.

User Data & Confidentiality

Any brand information, content, or data submitted through onboarding or revisions is used solely to deliver your services. We do not claim ownership of your brand assets.

Disclaimers

We provide marketing strategy, content, and templates.
We do not guarantee:
Revenue outcomes
Specific email or content performance
SEO results
Sales conversion rates
All materials are provided “as is” without warranties of any kind.

Limitation of Liability

To the fullest extent permitted by law, Brooks Advertising, Inc. is not liable for:
Indirect or consequential damagesLoss of data, profits, or business
Delays or issues caused by third-party platforms (Webflow, Gumroad, Stripe, etc.)
Your sole remedy is to discontinue use of the Site or services.

Governing Law

These Terms are governed by the laws of the State of Arkansas. Disputes shall be resolved in courts located in Pulaski County, Arkansas. Dispute Resolution Before initiating any legal action, you agree to contact us in writing and allow a reasonable opportunity to resolve the dispute informally. Legal action may not be initiated until such efforts have been made.

Updates to Terms

We may update these Terms from time to time. Continued use of the Site constitutes acceptance of the revised Terms.
